GENERAL TERMS AND CONDITIONS



1. Scope of Application

These General Terms and Conditions shall apply to all offers, orders, purchases and sales, as well as all other legal transactions, deliveries and services.

Any deviating business or contractual terms and conditions shall not be recognized by Therme St. Kathrein unless expressly confirmed in writing by Therme St. Kathrein. In the event of such written acceptance, this shall apply only to the respective transaction.

These General Terms and Conditions shall also apply to all other legal transactions with the contractual partner.

The following fundamental provisions shall also apply: the E-Commerce Act, the Consumer Protection Act (KSchG), all other applicable laws, and the House and Bathing Regulations of Therme St. Kathrein.

2. Offer, Order, Commission, Order Confirmation

(1) With regard to quantity and specifications, the contractual partner shall comply precisely with the request of Therme St. Kathrein in its offer and shall expressly notify Therme St. Kathrein in writing in advance of any deviations. If this requirement is not complied with, the contractual partner shall have no entitlement to higher remuneration in the event of deviations.

(2) Only orders and commissions placed via the web shop or by telephone with the administration shall be valid.

(3) Therme St. Kathrein undertakes to accept the purchaser's voucher or goods order subject to the conditions stated on the website. In the event of typing, printing or calculation errors on the website, Therme St. Kathrein shall be entitled to withdraw from the contract.

A purchase contract for a voucher shall be concluded when the customer receives an order confirmation by telephone or an automatic order confirmation from the web shop.

3. Vouchers

Vouchers cannot be redeemed for cash.

If the value of the goods or services purchased is lower than the value of the voucher, the difference cannot be credited or paid out in cash.

It is not possible to pay an additional amount to upgrade individual hourly tickets. However, an additional charge for the sauna can be paid for any tariff.

4. Prices, Packaging, Handling, Delivery

The agreed prices are fixed prices and may not be increased for any reason whatsoever.

The contractual partner shall be responsible for proper packaging and for all disadvantages, in particular damage, incurred by Therme St. Kathrein as a result of inadequate packaging.

The contractual partner shall provide any storage and/or operating instructions together with the delivery without being requested to do so.

If the contractual partner fails to comply with this obligation, the contractual partner shall be liable, irrespective of fault, for the full extent of any damage resulting from the lack of such information.

Therme St. Kathrein shall not be liable for delays caused by postal delivery.

5. Performance Period, Delivery Deadlines

(1) Services shall be provided at the time, place and in the scope or quantity specified in the contract or order. The performance period shall commence on the date of the order/commission.

(2) If a delay in performance occurs or is foreseeable, the contractual partner shall notify Therme St. Kathrein thereof immediately in writing.

In the event of a delay by the contractual partner, Therme St. Kathrein may withdraw from the contract or grant the contractual partner a reasonable grace period.

(3) The delivery of goods and vouchers by Therme St. Kathrein shall be carried out via Austrian Post under the applicable terms and conditions.

Delivery shall be made to the delivery address provided by the purchaser.

If a supplier fails to deliver to Therme St. Kathrein despite being contractually obliged to do so, Therme St. Kathrein shall be entitled to withdraw from the contract.

6. Invoicing, Payment

(1) Invoices must comply with the applicable statutory requirements.

(2) All voucher orders shall only be delivered against advance payment.

(3) Payment for web ticket purchases shall be made exclusively by direct debit. Discounts and promotional offers cannot be applied.

7. Data Protection

Therme St. Kathrein undertakes not to disclose to unauthorized third parties the data required for processing orders, in compliance with the applicable data protection regulations.

8. Right of Withdrawal

(1) Therme St. Kathrein shall be entitled to withdraw from the contract, in whole or in part, in the event of delay in performance, insolvency of the contractual partner or rejection of insolvency proceedings due to lack of assets, suspension of payments, or force majeure.

(2) Purchasers who are consumers within the meaning of the Consumer Protection Act may withdraw from a contract concluded at a distance, or from a contractual declaration made at a distance, within a period of 14 working days from the date of ordering the tickets.

It shall be sufficient for the declaration of withdrawal to be sent within this period; no reasons need to be given. Saturdays shall not be counted as working days.

In the event of withdrawal, a full or partial refund of the purchase price shall only be made simultaneously with the return of the goods received by the purchaser.

The costs of returning the goods shall be borne by the customer.

The goods should be returned unused, in a condition suitable for resale as new, and in their original packaging.

For items showing signs of use or with damaged packaging, an appropriate amount may be charged to compensate for the reduction in value.

9. Newsletter – Subscription & Unsubscription

By submitting the form on the Therme St. Kathrein website, the purchaser expressly consents to receiving the Therme St. Kathrein newsletter in the future, provided that such a newsletter is offered by Therme St. Kathrein.

The purchaser may unsubscribe from the newsletter at any time.

By clicking on “Unsubscribe from newsletter” in the newsletter, the subscriber will be directed to the Therme St. Kathrein website, where the relevant instructions must be followed.

10. Courses

Failure to attend a course session does not entitle the participant to a refund of the course fee. Therme St. Kathrein is not obliged to make up missed course sessions.

In the event of a short-notice cancellation of a course session by Therme St. Kathrein, for example due to illness of the course instructor, there shall generally be no entitlement to a refund of the course fee. The cancelled session will, where possible, be rescheduled for another date or conducted by a suitable substitute instructor.

The course instructor's duty of supervision shall apply exclusively during the scheduled course time. Outside this period, the duty of supervision shall remain with the parents or the respective accompanying persons.

Course participants are required to follow the instructions of the course instructor and comply with the general rules of conduct and safety regulations of Therme St. Kathrein.

In the event of serious or repeated violations of these rules, the respective participant may be excluded from the course. In such cases, there shall be no entitlement to a refund of the course fee.

Therme St. Kathrein shall be entitled, in the event of a course cancellation due to illness or failure to reach the required minimum number of participants, to withdraw from the course contract or to reschedule the course to another date. In the event of rescheduling, the course fee already paid shall be credited towards the replacement date.

For swimming courses, children must be personally accompanied by their parents or accompanying persons to the thermal spa ticket desk and must be picked up there punctually at the end of the course.

The exact handover location may vary depending on the instructor and the course. The general meeting point is the thermal spa ticket desk.

11. Final Provisions

Should any of the above provisions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.

All other provisions of these General Terms and Conditions shall remain in force.

The invalid provision shall be replaced by a valid provision that comes as close as possible to the invalid provision in terms of its content and purpose.
